Minding Me is not medical care
Please read this first
Minding Me is a self-reflection and wellness tool. It is not therapy, it is not medical advice, and it is not a medical device. It does not diagnose, treat, cure, or prevent any condition, and nothing in it should be taken as a clinical opinion about you.
It is also not a crisis service. Nobody is monitoring what you write. If you are in immediate danger, or you are thinking about harming yourself, call your local emergency number now — 911 in the US and Canada, 999 or 112 in the UK and Europe.
The app surfaces free crisis lines, and you can reach them whether or not you use Minding Me:
- 988 — Suicide & Crisis Lifeline, US and Canada (call or text)
- 116 123 — Samaritans, UK and Ireland (free, 24 hours)
- Text HOME to 741741 — Crisis Text Line
Using Minding Me is not a substitute for care from a doctor, therapist, or other qualified professional. Never disregard professional advice, or delay seeking it, because of something you read or wrote in the app. If you are already in treatment, talk to your clinician before changing anything about it.
This agreement
These terms are between you and IMind.Co LLC, a California limited liability company at 4522 Woodman Avenue, C329, Sherman Oaks, CA 91423, USA ("we", "us"). Minding Me is our product. By downloading or using the app, you agree to these terms; if you do not agree to them, please do not use the app.
Our Privacy Policy explains what we do with your information and forms part of this agreement.
Who can use it
You must be at least 18 years old to use Minding Me. By using it, you confirm that you are. The app is built for adults, and we do not knowingly allow accounts for anyone younger.
About the AI reflections
When you ask for a reflection, it is generated by an AI model. It is not written by a person, and no person reviews it before you see it.
AI reflections can be wrong, incomplete, or simply miss the point. They are not advice of any kind — clinical, medical, psychological, legal, or financial. Treat a reflection as a prompt for your own thinking, nothing more. If something it says worries you or does not sit right, please talk to a qualified professional rather than acting on it.
Asking for a reflection sends that entry to be processed by a third party. The Privacy Policy sets out exactly what is sent and to whom.
Your licence to use the app
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use Minding Me on devices you own or control, for your own non-commercial use. We keep all rights in the app itself — its software, design, content, and name. This licence does not transfer any of that to you.
Acceptable use
Please do not:
- Use the app for anything unlawful, or to harm anyone
- Try to access another person's account, entries, or recordings
- Reverse engineer, decompile, or attempt to extract the source code, except where law gives you that right regardless of this clause
- Interfere with the service, probe it for vulnerabilities without our permission, or put load on it in a way that degrades it for other people
- Resell, sublicense, or commercially redistribute any part of the app
- Use the app or its outputs to build a competing product or to train a model
Your entries belong to you
You own everything you write and record in Minding Me. We do not claim any ownership of your journal entries, notes, or voice recordings.
So that the app can actually work, you give us a narrow licence to store, back up, transmit, and display your content to you — and to send it for processing when you specifically ask for something that requires it, such as an AI reflection or a transcription. That licence exists only to run the service for you, it extends no further, and it ends when you delete the content or your account.
We do not use your journal content to train AI models — not ours, not anyone else's. We do not publish it, sell it, or show it to anyone.
You are responsible for your own content, and for keeping your own copies of anything you would be upset to lose.
Subscriptions and billing
Minding Me may offer auto-renewing subscriptions. Where it does, the title and duration of the subscription and its price are shown to you in the app before you confirm any purchase, and no charge is made until you do.
- Payment is charged to your Apple ID when you confirm the purchase.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period, at the price for the same duration.
- You manage and cancel subscriptions in your Apple account settings — not in the app. Turn off auto-renewal there.
- Deleting the app does not cancel a subscription. You have to cancel it in your Apple account settings.
- We cannot issue refunds directly. Purchases go through Apple, so refunds are handled by Apple under its own terms. We are happy to help you ask, but the decision is theirs.
- If we change the price, that change applies from your next renewal and only after Apple has notified you and given you the chance to cancel.
Apple
These terms are required by Apple for apps distributed on the App Store, and they apply to the iOS version of Minding Me.
- This agreement is between you and IMind.Co LLC. It is not with Apple. Apple is not a party to it, and we alone are responsible for Minding Me and its content.
- Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to the app.
- Apple is not responsible for addressing any claims relating to the app — including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. We are responsible for those.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes that party's intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple will have the right — and is deemed to have accepted the right — to enforce these terms against you.
Third-party links and services
The app links to our shop at theimindco.com. Although the same company runs it, it is a separate website: anything you buy there is governed by the shop's own terms, not by this page.
The app also relies on services from other companies, including Apple. Where you follow a link out of the app or use one of those services, their terms apply to that part, and we are not responsible for their content or conduct.
Ending this agreement
You can stop using Minding Me at any time by deleting the app, and you can ask us to delete your account and its data as described in the Privacy Policy.
We may suspend or end your access if you materially breach these terms — particularly the acceptable use section — or if we are required to by law. Where it is reasonable to do so, we will tell you first and give you a chance to put it right. We may also discontinue the app itself, in which case we will give you reasonable notice and a way to export your entries.
Disclaimer of warranties
Minding Me is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or secure against every possible attack, that any defect will be corrected, or that any particular outcome — including any improvement in how you feel — will follow from using it.
Nothing here excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
Limitation of liability
To the fullest extent permitted by law, IMind.Co LLC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or anticipated savings, arising out of or in connection with your use of Minding Me — whether the claim is in contract, tort (including negligence), or otherwise, and even if we were told such damages were possible.
To the extent liability cannot be excluded entirely, our total aggregate liability arising out of or relating to these terms or the app is limited to the total amount you have paid us for Minding Me.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you, and your statutory rights as a consumer are unaffected.
Indemnity
You agree to indemnify and hold IMind.Co LLC harmless from any claim, demand, loss, or expense — including reasonable legal fees — arising from your misuse of Minding Me, your breach of these terms, or your violation of any law or of anyone else's rights. This does not apply to the extent the claim arises from our own breach or negligence.
Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts in Los Angeles County, California for any dispute arising out of them.
If you are a consumer in the UK or the European Union, this does not deprive you of the protection of the mandatory consumer laws of the country you live in, or of your right to bring proceedings in your local courts.
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing something straight away is not a waiver of our right to enforce it later.
Changes to these terms
We may update these terms as the app changes. When we do, we update the date at the top of this page. If a change materially affects your rights, we will give you notice in the app before it takes effect. Continuing to use Minding Me after that means you accept the updated terms; if you would rather not, you can stop using the app and ask us to delete your account.
